1. Definitions

1. "SCM Cripto" or "Platform" refers to the technology platform operated by SCM Cripto, headquartered in Seychelles.
2. "Services" refers to the payment infrastructure, liquidity platform and related technology services provided by SCM Cripto.
3. "User" or "You" refers to any individual or entity that accesses or uses the Platform.
4. "DePix" refers to the decentralized payment protocol and stablecoin system as defined by the official DePix specifications (https://www.depix.info).
5. "PIX" refers to the Brazilian instant payment system regulated by the Central Bank of Brazil.

2. Nature of Services

1. SCM Cripto operates as a technology platform and technological intermediary, providing payment infrastructure services.
2. SCM Cripto is NOT a bank, is NOT a financial institution, and is NOT a custodian of funds.
3. SCM Cripto does NOT provide banking services, accept deposits, or act as a financial intermediary in the traditional sense.
4. Services are provided "as is", and SCM Cripto makes no warranties regarding the availability, reliability, or performance of the Services.

3. User Obligations

1. Users must provide accurate and truthful information when using the Platform.
2. Users must comply with all applicable laws and regulations in their jurisdiction.
3. Users must NOT use the Services for illegal activities, including but not limited to:
   • Money laundering
   • Terrorism financing
   • Fraud or fraudulent activities
   • Any activity prohibited by applicable law
4. Users are responsible for maintaining the security of their account credentials and for all activities that occur under their account.

4. DePix and PIX Compliance

1. SCM Cripto uses DePix in accordance with:
   • Public rules and technical specifications defined by Eulen App
   • Official DePix Specifications
   • Applicable Brazilian legislation on PIX usage
2. Users acknowledge that transactions involving PIX and DePix are subject to the rules and regulations of the respective protocols and applicable jurisdictions.
3. SCM Cripto does NOT guarantee the performance, availability, or value stability of DePix or any other cryptocurrency or digital asset.

5. Limitations of Liability

1. To the maximum extent permitted by law, SCM Cripto will NOT be liable for:
   • Any loss of funds, digital assets, or value
   • Service interruptions or unavailability
   • Technical failures or errors
   • Loss of data or information
   • Indirect, incidental, or consequential damages
2. Users acknowledge that digital assets and cryptocurrencies are subject to market volatility and technological risks.
3. SCM Cripto does NOT provide investment advice or guarantee financial returns.

6. Intellectual Property

1. All content, software, and materials on the Platform are the property of SCM Cripto or its licensors and are protected by intellectual property laws.
2. Users may NOT copy, modify, distribute, or create derivative works based on the Platform without explicit written permission.

7. Jurisdiction and Applicable Law

1. These Terms are governed by the laws of Seychelles, where SCM Cripto is headquartered.
2. Any disputes arising from these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the courts of Seychelles.
3. For users in Brazil, applicable Brazilian regulations may also apply when interacting with PIX-related services.

8. Modifications of Terms

1. SCM Cripto reserves the right to modify these Terms at any time.
2. Continued use of the Platform after modifications constitutes acceptance of the updated Terms.
3. Users are responsible for reviewing these Terms periodically.

9. Termination

1. SCM Cripto reserves the right to suspend or terminate access to the Platform at any time, with or without prior notice, for any reason.
2. Users may discontinue use of the Platform at any time.
